In 2019, the Securities and Exchange Commission (SEC) charged them with breaching their fiduciary duty in connection with a $6 million municipal bond offering for the Harvey Public Library District in Illinois.23 The SEC alleged that they failed to provide adequate advice on underwriter selection and bond pricing, resulting in unfavorable terms for their client.3 In January 2024, a final judgment was obtained, ordering Comer Capital to pay disgorgement and civil penalties, though the defendants did not admit or deny the allegations.2
